A response from WC.

Following the notification of a drop-kerb request for the site off Ashton Road, I contacted WC asking whether the local councillor, or the public, would be involved in the decision.

 

The reply is below:[

"Dear Ernie,

Where the access to be constructed is onto a classified road then Planning Consent is required. Anyone wishing to construct a private vehicle access from the highway into their property must apply to us for permission to do so under Section 184 of the Highways Act 1980, this requirement is added as an informative on an approved planning permission.

Where the access to be constructed is onto an unclassified road, only permission under Section 184 of the Highways Act 1980 is required.

Applications apply to any proposed new dropped kerb, including the extension or alteration of an existing dropped kerb, alterations to a made-up vehicle crossing or where a property does not have a kerb outside, but still wishes to enter the property from the highway.

Decisions under Section 184 of the Highways Act 1980 are officer decisions, based on auditing the designs against the approved specification, with no member involvement.
