Wiltshire Council is reminding residents to check who they give their waste to after a Swindon resident was issued with a £600 fixed penalty notice (FPN) when their waste was found fly-tipped.
Wiltshire Council’s Environmental Enforcement Officers launched an investigation after a significant amount of waste, including cardboard, polystyrene and plumbing materials, was discovered along the Ridgeway in Broad Hinton.
During their investigation, officers identified evidence that led them to a person in Swindon. When interviewed, they explained that they had paid a person they believed to be a legitimate waste removal operator to dispose of the items. However, the waste was subsequently found to have been illegally fly-tipped.
Householders have a legal duty to ensure their waste is disposed of correctly. This includes any waste that is passed to a third party. Failing to make the appropriate checks can result in enforcement action - even if someone else physically dumps the waste.
Because the resident did not say who they gave their waste to, they failed to meet their household duty of care and were issued with a £600 FPN. As an FPN is not the same as a court conviction, the person cannot be named.
